Apex court refuses to quash Bihar caste census

One of the petitioners had alleged that the Bihar government notification was 'against the basic structure of the Constitution.' The petitioner alleged that the state government's action was illegal, arbitrary, irrational and unconstitutional. The state could not have gone ahead with the move in the absence of a legislation or an enabling constitutional provision.
